FootageFerret is sold by Ninmo Productions Limited, trading as FootageFerret. The paid licence is a one-time purchase that keeps working, with two years of updates included.
Your consumer rights still apply
These terms do not exclude, restrict or replace any rights or remedies that cannot lawfully be excluded, including rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986.
1. Who these terms are between
These terms are an agreement between you and Ninmo Productions Limited, a New Zealand company trading as FootageFerret. They apply to FootageFerret, FotoFerret, the installer, updates and related documentation.
By installing or using the software, you accept these terms. If you do not accept them, do not use the software.
2. Free and paid use
Free edition
You may use the Free edition to scan and catalogue up to 1,000 clips or photos. You can continue browsing an existing catalogue after reaching that limit.
Full licence
A Full licence removes the catalogue limit. It includes updates released during the two years following the original purchase date. When that update period ends, the versions you were entitled to keep using do not expire.
Update extension
An update extension adds two years to the later of your current update entitlement date or the extension purchase date. It does not create a separate Full licence.
3. What the licence allows
We grant you a personal, limited, non-exclusive, non-transferable licence to install and use FootageFerret for your own individual or business work. A paid licence may be active on up to three computers that you control, subject to reasonable reset assistance when hardware is replaced.
You keep ownership of your footage, photos, catalogue information and other material. The licence does not give FootageFerret any ownership rights in that material.
4. What the licence does not allow
You must not:
- share, sell, rent, sublicense or publish your licence key;
- redistribute FootageFerret, its installer or bundled models as another product;
- circumvent the Free edition limit or licence checks;
- reverse engineer or modify the software except where applicable law expressly permits it;
- use the software in a way that infringes another person’s rights or breaks the law.
5. Local analysis and your responsibility
FootageFerret is designed to analyse media locally and keep original files in place. Titles, descriptions, tags, camera details and search results are generated or inferred and may be incomplete or wrong. Check important information before relying on it in production, delivery, rights management or archive decisions.
Maintain a separate backup of original media and important catalogue data. FootageFerret is an archive search tool, not a backup service.
6. Updates, support and online services
Paid use requires an internet connection for activation and periodic licence checks. The app checks on startup and normally once a day. If the service or your internet connection is temporarily unavailable, a previously verified licence has a grace period of up to seven days from its last successful check. A confirmed refund, revocation or computer removal ends paid access when the app next receives that confirmation.
Your catalogue, descriptions, lists, notes and previews are kept. You can continue browsing and searching them even if paid access ends or your catalogue contains more than 1,000 items. New analysis is limited by the Free edition until paid access is restored.
The two-year update period covers versions released during that period. An eligible installed version does not expire when that period ends, but remains subject to licence validation. Original media drives may stay disconnected while you browse saved catalogue data and previews.
Use the secure link sent to your purchase email to manage your three computer slots. Moving your catalogue to a new PC does not transfer an activation. We may improve features as the product develops. Support is available through [email protected].
7. Refunds and termination
Paid purchases include the 14-day money-back guarantee. A refunded licence is marked as refunded and may no longer be used.
We may terminate a licence for a serious or repeated breach of these terms. We will give reasonable notice and an opportunity to resolve the issue where that is appropriate. Clauses that are intended to continue after termination, including ownership and limits of liability, will continue.
8. Liability
To the maximum extent permitted by law, FootageFerret is supplied without guarantees beyond those stated in these terms or required by law. We are not liable for indirect or consequential loss, loss of profit, or loss caused by relying on an automatically generated description or classification.
Where liability can lawfully be limited, our total liability relating to a paid licence will not exceed the amount you paid for that licence. This limitation does not apply where the law does not allow it.
9. Governing law
These terms are governed by New Zealand law. The courts of New Zealand have non-exclusive jurisdiction. Mandatory consumer protections in your country may also apply.
